These Terms of Service govern your access to and use of the Spechy platform, including the application at app.spechy.com and all related features and services. Spechy is an AI omnichannel communication platform and customer relationship management (CRM) product that unifies voice, WhatsApp, Instagram, email, and live chat in a single inbox, with CRM, AI agents, payments, and speech analytics. Please read these terms carefully before using the service.
1. Acceptance of Terms
By creating an account, accessing, or using the service, you agree to be bound by these terms. If you are entering into these terms on behalf of a company or other organization, you represent that you have the authority to bind that entity, and references to “you” mean that entity. If you do not agree to these terms, you may not use the service.
2. Description of the Service
Spechy provides a hosted platform that brings together multiple communication channels into one inbox, along with CRM, automation, AI agents, payment processing, and analytics tools. We may add, change, or remove features over time to improve the service. Some features may depend on third party providers or integrations that you choose to connect.
3. Accounts and Eligibility
To use the service, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must promptly notify us of any unauthorized use. You must be able to form a binding contract and use the service only for lawful business purposes.
4. Acceptable Use
When using the service, you agree not to:
- Violate any applicable law, regulation, or third party rights.
- Send unsolicited or unlawful messages, spam, or content that you are not authorized to send.
- Upload malicious code or attempt to disrupt, damage, or gain unauthorized access to the service.
- Reverse engineer, copy, or resell the service except as expressly permitted.
- Use the service to harass, defraud, or harm others.
- Exceed usage limits or interfere with the proper functioning of the platform.
You are responsible for ensuring that your use of communication channels complies with the rules of the underlying providers and with consent and messaging laws that apply to your contacts.
5. Customer Data and Ownership
You retain ownership of the data you submit to the service, including your contact records, messages, and other content (your customer data). You grant Spechy a limited license to host, process, and transmit your customer data as needed to provide and improve the service and as described in our Privacy Policy. You are responsible for the accuracy and legality of your customer data and for having the rights and consents needed to process it through Spechy.
6. Subscriptions, Billing, and Trials
Paid features are offered on a subscription basis. Unless stated otherwise, subscriptions renew automatically for successive periods until canceled. Fees are billed in advance and are non refundable except where required by law or expressly stated. We may change pricing with reasonable advance notice, and changes take effect at your next renewal.
If we offer a free trial, we will describe its terms at sign up. At the end of a trial, your subscription may convert to a paid plan unless you cancel beforehand. You are responsible for any usage based charges incurred during a trial.
7. Payments and Spechy Pay
Payments may be processed through Spechy Pay or our other payment partners. By providing payment details, you authorize us and our partners to charge the applicable fees. You agree to keep your payment information current. If a payment fails or is overdue, we may suspend or limit access to paid features until the balance is settled. Where you use Spechy Pay to collect payments from your own customers, you are responsible for your transactions and for complying with the applicable payment rules.
8. Third Party Integrations
The service can connect to third party tools, channels, and providers that you choose to enable. Those integrations are governed by the third party’s own terms and privacy policies, and Spechy is not responsible for their availability, accuracy, or actions. If a third party changes or discontinues its service, the related features in Spechy may be affected.
9. Intellectual Property
The Spechy platform, including its software, design, trademarks, and content (other than your customer data), is owned by Spechy and its licensors and is protected by intellectual property laws. We grant you a limited, non exclusive, non transferable right to use the service during your subscription. All rights not expressly granted are reserved. You may not remove or obscure any proprietary notices.
10. Confidentiality
Each party may have access to confidential information of the other in connection with the service. Each party agrees to protect the other’s confidential information with reasonable care and to use it only as needed to perform under these terms. This obligation does not apply to information that is public, independently developed, or rightly received from another source without restriction.
11. Warranties and Disclaimers
We strive to provide a reliable, high quality service. However, except as expressly stated, the service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the service will be uninterrupted, error free, or free of harmful components, or that AI generated outputs will always be accurate.
12. Limitation of Liability
To the maximum extent permitted by law, Spechy and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service. To the extent permitted by law, our total liability for any claim relating to the service will not exceed the amounts you paid to Spechy for the service in the twelve months before the event giving rise to the claim.
13. Suspension and Termination
You may stop using the service and cancel your subscription at any time through your account settings. We may suspend or terminate your access if you breach these terms, fail to pay fees, or use the service in a way that creates legal or security risk. Upon termination, your right to use the service ends. We may make your customer data available for export for a limited period after termination, after which it may be deleted in line with our retention practices.
14. Changes to the Service and Terms
We may update the service and these terms from time to time. When we make material changes to these terms, we will update the date at the top of this page and, where appropriate, provide additional notice. Your continued use of the service after changes take effect means you accept the updated terms. If you do not agree, you should stop using the service.
15. Governing Law
These terms are governed by the laws applicable to Spechy’s place of business, without regard to conflict of law principles. Any disputes arising from these terms or the service will be subject to the jurisdiction of the competent courts in that location, unless mandatory law provides otherwise.
